Section 6.04.040 Article 1— Administration, Section 105— Permits amendments.

    A.     Section 105.2.1.1 (Permit Fees) is added to this code to read:

    The governing body pursuant to Section 13916 of the Health and Safety Code may establish fees for permits issued under the authority of this Code in all cases where permit fees have not been established hereunder.

    B.     Section 105.2.1.2 (Fees for Service) Alameda County Ordinance 0-93-17 (Fees for Service) is restated and incorporated into Section 105 as Section 105.2.1.2 of this code to read:

    1.    A fee shall be charged to cover the cost of any fire prevention service or of enforcing any regulation.
    2.    Any person or public entity who requests a permit, plan review, or an inspection shall file a completed application with the district’ s fire prevention bureau. The application shall be accompanied by the scheduled nonrefundable fee.

*    The permit fee is an estimate based on the cost of basic service including but not limited to office reviews and field inspections. The actual amount charged is based on actual time spent. Extra cost incurred due to system failure, unusual circumstances, excessive time required, missed appointments and personnel expense shall be billed at the rate of $80.00 per hour in 1/2 hour increments in addition to the basic service fee.

**    Fire permits that are not covered by an annual permit shall submit application for permit required for each occurrence. In addition to the fire permit, fireworks displays must have one engine company on standby during the event at the expense of the permit holder. Event time includes 1/2 hour.



    3.    Contractors, Developers or Property Owner/Builders who utilize a department approved Fire Sprinkler Designer or Consultant may not be required to pay additional fees for consultant’ s review of system plans and calculations. The fee for plan review and inspection will be adjusted to reflect this reduction in fees.
    4.    A permit, certification, or approval shall not be issued until all requirements have been satisfied and the fee has been paid in full.
    5.    The Building Official shall not issue a final clearance until approval has been issued by the Fire Department and the total fee has been collected by the Fire Department.
