Every person is guilty of a misdemeanor who, on or after December 31, 1954, transports or conveys, or causes or permits to be transported or conveyed, upon or along any public highway through or across the unincorporated territory of the county, any garbage, or refuse garbage, or commercial garbage, unless an effective license or permit in writing has been issued by the county health officer applicable to the vehicle or truck by means of which such transportation occurs, or unless such garbage, refuse garbage, or commercial garbage is enclosed in a water-tight, leak-proof, insect- and rodent-proof container having in place a tight-fitting cover so as to prevent leakage, spillage or overflow.
