Chapter 6.48 JUNK VEHICLES
Section 6.48.180 Violation— Penalty.
A. It shall be unlawful and an infraction
for any person to abandon, park, store or leave or
permit the abandonment, parking, storing or leaving of any licensed or unlicensed abandoned,
wrecked, dismantled or inoperative vehicle or parts thereof upon any private property or public
property not including highways within the unincorporated area of Alameda County.
B. Any person, firm or corporation
convicted of an infraction under the provisions of this
chapter shall be punishable upon the provisions of this chapter shall be punishable upon a first
conviction of a fine not more than one hundred dollars ($100.00) and for a second conviction
within a period of one year by a fine of not more than two hundred dollars subsequent conviction
within a one year period by a fine of not more than five hundred dollars ($500.00). Any violation
beyond the third conviction within a one-year period may be charged by the District Attorney as
a misdemeanor and the penalty for conviction of the same shall be subject to a fine or
imprisonment or both not to exceed the limits set forth in California Penal Code Section 19.
C. In Addition to the penalties here
and above provided any condition caused or permitted to
exist in violation of any of the provisions of this chapter shall be deemed a public nuisance and
may be by the county summarily abated as such.
D. Each person, firm or corporation
shall be guilty of a separate offense for each and every
day during any portion of which any violation of any provision of this code is committed,
continued or permitted by such person and shall be punishable accordingly.
E. The Planning Director or their
designee shall have the power to designate by written order
that particular officers or employees shall be authorized to enforce particular provisions of this
chapter. Officers or employees so designated shall have the authority to arrest persons who
