A.    Any violation of this chapter is an infraction punishable by (1) a fine of one hundred dollars ($100.00) for a first violation; (2) a fine of two hundred dollars ($200.00) for a second violation of this chapter within one year; (3) a fine of five hundred dollars ($500.00) for each additional violation of this chapter within one year.

    B.    As an additional remedy, the operation or maintenance of any device, instrument, vehicle or machinery in violation of any provision of this chapter, so as to cause a noise disturbance, shall be deemed and is hereby

declared to be a public nuisance and may be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction. (Ord. 2005-16 § 5: prior gen. code §§ 3-107.901— 3-107.903)
