Section 6.65.230 Violation and penalties.

    A.    Each person, firm, or corporation shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this chapter is committed, continued or permitted by such person and shall be punishable accordingly.
    B.    The enforcement officer shall have the power to designate particular officers or employees to enforce particular provisions of this chapter. officers or employees so designated shall have the authority to impose fines and/or fees.
    C.    If the planning director or their authorized representatives determine that a nuisance does not necessitate immediate summary abatement under the procedures set forth in section 6.65.070 et seq. the nuisance shall be deemed a violation, and a fine will be imposed on the owner of the property and/or anyone known to the County officer or representative to be in possession of the property.
    D.    The following is a schedule of fines and fees:

    The third documented occurrence of sections 6.65.030 (E), (F ) & (L) will constitute a violation and will be assessed a fine of one hundred dollars ($100.00) and a re-inspection fee of ninety-four dollars ($94.00) and is not subject to the Administrative Hearing process.
    A fine of five hundred dollars ($500.00) will be imposed if a second or subsequent violation of any subsection of 6.65.030 occurs within twelve (12) months of a previous violation.
    The owner(s) may appeal to the Board of Zoning Adjustments any fines or fees imposed by Enforcement officer by filing an appeal with the Clerk of the Board of Zoning Adjustments within ten calendar days from the date of service of invoice.
    *Staff time is ninety-four dollars ($94.00) per hour (billed in fifteen (15) minute increments).
