Commercial Cannabis Regulation in Unincorporated Alameda County

Project Description

Commercial cannabis operations in the State of California are regulated pursuant to a combined scheme for medicinal and adult use under the Medicinal and Adult-Use Cannabis Regulation and Safety Act ("MAUCRSA"). MAUCRSA provides for a dual licensing scheme: all cannabis business operators obtain permission from their local jurisdiction and from the relevant State of California regulatory agency.

In 2017, the Alameda County Ordinance Code was updated to allow permits for commercial medical cannabis cultivation, retail and delivery operations in the unincorporated area of Alameda County. This update included revisions to the County's existing ordinance regulating retail operations (Chapter 6.108), the addition of a new cultivation ordinance (Chapter 6.106), and revisions to the Zoning Ordinance (Title 17).

On 8 May, 2018, the County adopted ordinance amendments to allow permitted cannabis cultivation operations in the unincorporated area to grow both medical and adult use cannabis and permitted retail operations to sell both medical and adult use cannabis. These ordinance amendments will come into effect on 7 June, 2018 and the Alameda County Code of Ordinances, which is available here via the Municode Library, will be updated to reflect the changes.
