Commercial Cannabis Regulation in Unincorporated Alameda County

Project Description

Commercial cannabis operations in the State of California are regulated pursuant to a combined scheme for medicinal and adult use under the Medicinal and Adult-Use Cannabis Regulation and Safety Act ("MAUCRSA"). MAUCRSA provides for a dual licensing scheme: all cannabis business operators obtain permission from their local jurisdiction and from the relevant State of California regulatory agency.

Alameda County has conducted a comprehensive review and public consultation process and passed ordinance amendments to the Alameda County Ordinance Code to regulate commercial cannabis uses in unincorporated Alameda County. The ordinance code regulates permitting opportunities for the following commercial cannabis uses:

  • Cultivation
  • Retail
  • Combined Cannabis Operation
  • Delivery
  • Testing Labs

Hemp

Industrial hemp is not subject to the same permitting requirements as commercial cannabis. Hemp cultivation does not require a permit from the Planning Department.

Before growing hemp on land within unincorporated Alameda County, the grower needs to register with the Alameda County Department of Agriculture / Weights and Measures
